AI Terms of Use

1. Scope & Purpose
These AI Terms of Use (“AI Terms”) govern the use of artificial intelligence, machine learning, and automated decision-making technologies (“AI Systems”) provided by or through SimplySync AI (“Company,” “we,” “us,” or “our”). These AI Terms supplement and are incorporated into our general Terms of Service.
By using any SimplySync AI service that incorporates AI technology, you agree to these AI Terms. If you are a SimplySync AI client and deploy AI systems for your customers, you are responsible for ensuring your customers are informed of and comply with these terms as applicable.
2. Description of AI Services
SimplySync AI builds, deploys, and manages AI systems including but not limited to:
- AI conversational agents (chatbots) for web, SMS, and voice channels
- AI-powered lead qualification and follow-up automation
- Voice AI for inbound and outbound call handling
- AI content generation for marketing, follow-up messages, and communications
- Predictive analytics and AI-driven workflow routing
- AI-assisted CRM data enrichment and tagging
- Automated appointment booking and scheduling systems
These services are powered by third-party AI model providers including OpenAI, Anthropic, Google, and other providers (collectively, “Underlying AI Providers”). SimplySync AI does not own or control the underlying language models and is subject to the terms and usage policies of those providers.
3. No Warranty on AI Outputs
SimplySync AI makes no representations or warranties regarding the accuracy, completeness, reliability, timeliness, or suitability of any content, response, recommendation, or action generated by any AI System.
You acknowledge and understand that:
- AI Systems can and do produce incorrect, incomplete, misleading, or fabricated information (“hallucinations”)
- AI-generated content does not constitute professional, legal, financial, medical, or regulatory advice of any kind
- AI Systems may not always respond appropriately to sensitive, nuanced, or complex situations
- AI Systems may reflect biases present in their training data
- AI behavior may change over time as underlying models are updated by their providers
- AI Systems may occasionally fail, produce unexpected outputs, or become temporarily unavailable
4. Limitation of Liability for AI Outputs
SimplySync AI is not responsible or liable for any loss, damage, harm, liability, or legal consequence arising from:
- Reliance on AI-generated content, responses, or recommendations
- Actions taken (or not taken) by you or your customers based on AI outputs
- Errors, inaccuracies, or inappropriate responses generated by AI Systems
- Changes in AI System behavior due to third-party model updates
- AI system downtime, latency, or technical failures caused by Underlying AI Providers
- Claims made by your customers related to AI-generated communications sent on your behalf
- Regulatory enforcement actions related to your use of AI communications
- Reputational harm arising from AI-generated content
You accept full responsibility for all AI-generated communications sent under your account and to your customers. We recommend maintaining human oversight of AI systems and reviewing AI outputs regularly.
5. Third-Party AI Provider Terms
Our AI Services are built on top of third-party AI platforms. By using our services, you also agree to comply with the applicable usage policies of those providers, including:
- OpenAI Usage Policy (openai.com/policies/usage-policies)
- Anthropic Usage Policy (anthropic.com/policies)
- Google AI / Gemini Terms of Service
- Other providers as applicable to your specific deployment
SimplySync AI reserves the right to modify or discontinue AI features as required by Underlying AI Providers’ policy changes, pricing adjustments, or service modifications, without liability to you.
6. Data Use in AI Systems
6.1 Data Processed by AI
When AI Systems process conversations, inquiries, and customer interactions, certain data is transmitted to and processed by Underlying AI Providers. This may include message content, contact information passed via system prompts, and context data necessary for the AI to respond accurately.
6.2 AI Training
By default, we configure our AI integrations to opt out of data being used to train Underlying AI Provider models where such options are available. However, we cannot guarantee that all providers offer this option or that policies will not change.
6.3 Your Responsibilities
You are responsible for ensuring that your customers are aware that their communications may be processed by AI systems, and for obtaining any consents required by applicable privacy laws (including GDPR and CCPA) before routing customer data through AI systems.
7. AI Disclosure Requirements
You agree to comply with all applicable laws and regulations requiring disclosure of AI or automated system use, including but not limited to:
- Disclosing AI use in SMS programs as required by TCPA and carrier guidelines
- Disclosing AI use in telephone conversations where required by state law (e.g., California B.O.T. Disclosure Act)
- Providing a mechanism for consumers to request human escalation
- Not deploying AI systems to deceive consumers into believing they are communicating with a human
SimplySync AI AI systems are configured by default to disclose AI status when directly asked. Clients may not disable this feature or configure AI systems to falsely claim to be human.
8. Prohibited Uses of AI Systems
You may not use SimplySync AI’s AI systems to:
- Generate, distribute, or promote illegal, harmful, defamatory, discriminatory, or deceptive content
- Engage in consumer fraud, deceptive trade practices, or misrepresentation
- Violate any applicable law, including consumer protection and communications laws
- Send unsolicited communications or spam in any form
- Impersonate a real person, government agency, or regulated professional (e.g., attorney, physician, financial advisor)
- Generate medical diagnoses, legal advice, financial investment guidance, or other regulated professional advice
- Facilitate harassment, intimidation, or discrimination against any individual or group
- Collect sensitive personal information (social security numbers, payment card data, medical records) through AI conversation channels
- Circumvent, disable, or tamper with safety features built into AI systems
- Reverse-engineer, extract, or replicate AI model weights, system prompts, or proprietary configurations
Violation of these prohibitions constitutes a material breach of your Service Agreement and may result in immediate termination of services without refund.
9. Intellectual Property in AI Outputs
AI-generated content (text, suggestions, drafted messages, etc.) produced through our systems is owned by you as the operator of record, subject to the terms of Underlying AI Providers. SimplySync AI claims no ownership over AI-generated outputs produced for your use.
You represent and warrant that your use of AI-generated content does not infringe on the intellectual property rights of any third party. SimplySync AI is not liable for any intellectual property infringement arising from AI-generated content produced at your direction.
10. Regulatory Compliance
AI regulations are evolving rapidly. You are solely responsible for ensuring your use of AI systems complies with all applicable laws in your industry and jurisdiction, including but not limited to:
- FTC guidelines on AI and endorsements
- State AI disclosure laws (California, Colorado, Texas, etc.)
- EU AI Act (if applicable)
- Industry-specific regulations (HIPAA for healthcare, FINRA for financial services, etc.)
- State consumer protection and deceptive trade practices statutes
SimplySync AI does not provide legal advice. We strongly recommend consulting with qualified legal counsel before deploying AI systems in regulated industries.
11. Human Oversight Recommendation
While our AI systems are designed to perform autonomously with high accuracy, we strongly recommend that you maintain appropriate human oversight over AI communications. This includes:
- Regularly reviewing conversation logs and AI-generated messages
- Establishing human escalation protocols for complex or sensitive inquiries
- Monitoring for unexpected AI behavior or off-topic responses
- Providing feedback to SimplySync AI when AI outputs are inaccurate or inappropriate
- Not relying solely on AI for high-stakes decisions (pricing disputes, medical referrals, legal matters)
12. Changes to AI Systems
SimplySync AI reserves the right to update, modify, retrain, replace, or discontinue AI features at any time, including as required by changes to Underlying AI Provider terms, model availability, or applicable law. We will provide reasonable advance notice of material changes where possible. Continued use of AI-powered services after such changes constitutes acceptance.
